Personal Responsibility Essay Personal responsibility is extremely important in life because it dictates the quality of your life. Your life is directly affected by the level of personal responsibility you practice. The definition of personal responsibility is vague and broad. It is comparable to defining a personality trait that includes several traits in one. These traits include ethics, moral decisions, freedom of choice, self-discipline and accountability. Personal responsibility also plays a vital role in your success as a student. Your success as a college student has a direct correlation with personal responsibility. As a college student it is also important to have strategies in place for your success. Having a plan on how you are going to succeed keeps you on track and helps you to enhance your personal responsibility. Personal responsibility does not have the same meaning for everyone or the value that is placed on this practice. What is Personal Responsibility Responsibility is something that exists in the lives of everyone. On a daily basis we are required to satisfy some form of personal responsibility. If I had to define the word personal responsibility I would define it as consistently following through with what needs to be done and establishing a level of self-discipline and trust. The dictionary states the definition of responsibility as the state, quality or fact of being responsible; a duty, obligation or burden. There are many levels of responsibility: financial responsibility, economic responsibility, professional responsibility, and so on. I want to elaborate on personal responsibility. I believe this particular level also incorporates ethics and morals in its definition as well. Moral responsibilities are equally pervasive, in that we are vulnerable human beings, caring for and cared by others. Moral sentiments relate to things that we have reason to value, moving us into actionâ⬠(Sanghara, Ablezova, Botoeva, 2011). Personal responsibility encompasses your ethical beliefs which also requires you to admit to your mistakes. It seems we live in a world where that is not practiced as often as it should. ââ¬Å"Doing the right thing whether or not it is witnessed by others is a key part of taking personal responsibility for your actionsâ⬠(Tracey, 2011). The demise of personal responsibility occurs when individuals blame their family, their peers, their economic circumstances, or their society for their own failure to meet standardsâ⬠(Haskins, 1996). It is so easy to place the blame of your problems on your environment. I believe this particular part of personal responsibility is the hardest to practice. If we all took the time to be aware of our lack of acceptance of our problems and started placing the blame on our own failures, we as individuals will have a whole new sense of freedom. This new freedom can be comparable to a weight being lifted of our shoulders and we can finally start taking control of our lives. This particular part of personal responsibility should be included in the dictionary definition because I believe it is easily over looked. Personal responsibility also encompasses our right of freedom. Our level of responsibility is surrounded by choices. We have the freedom to choose how we are going to fufill our obligations, the level of accountability we display, and whether or not we will accept when we made a mistake. The subject is condemmed to be free, and to decide for himself/herself. Such a freedom is also related to his or her own responsibility, because his or her decisions will have to be made without any refrence to any higher ethical norm else that the one the subject is defining for himselfâ⬠(Ballet, Dubois, Mahie, 2007). In other words, we are able to make our choices of responsibility and we do not have to answer to anyone. This makes it easier to make irresponsible choices. We are 100 percent in charge of our outcomes. This makes it imperative for us to use our freedom wisely. Consistently choosing to be responsible, accountable, and ethical creates a foundation for a happier life. This equates to our life being in our hands and no one elses. In my definition of personal responsibility I used the word self-discipline and trust. I believe these two terms are key components of the act of being responsible. If someone is consitently responsible you know that you will be able to trust that person with something that is important to you. A responsible person has a proven track record of following through with their obligations or the obligations of others. Self-discipline goes along with freedom. Freedom, in essence, is a priveledge that must be exercised properly. The abilty to recognize freedom is crucial and to do the right thing is a key element of personal responsibility. Self-discipline is the restraint that is necessary to stay within the ethical boundaries of decision making and it is the power you have inside you to finish all the necessary tasks that are in front of you. There are obligations that we are required to fulfill, but most of the time we do not have to answer to anyone when we do not meet our obligations. Consequences are most always present, but tend not to be enough to stop us from our irresponsible actions. â⬠â⬠¦a responsible agent is one who is self-conciously self-determinedâ⬠(Spector, 2008). Personal responsibilty is having the knowledge to say no when certain situations arise and that comes with self-discipline. Personal Responsibility and College Success The level of personal responsibility you practice will directly affect the amount of success you achieve in higher education. Your work load can essentially double while you are in a college setting because this type of learning environment usually consists of adults that have jobs and families. College success will require you to make moral and ethical decisions, exercise self-discipline, and be accountable. All of these terms are related and involve personal responsibility which can be summed up with this citation, ââ¬Å"Itââ¬â¢s the absolute minimum requirement for the accomplishment of everything you could ever really want in lifeâ⬠(Tracey, 2011). Personal responsibility is required in our daily lives and is required for college success in the same regard. We are in charge of our outcomes and if the outcome we are striving for in college is success with a degree, we have nothing standing in our way. The only thing we need to do is be aware of the level of responsibility we currently have and the level of personal responsibility we need to maintain. With this in mind, meeting the demands of a college student can be easily managed. Effective Strategies to be a Successful Student To fully incorporate personal responsibility in your college life it is beneficial to be prepared. Being prepared includes coming in with some type of idea and organization. A very simple and effective way to manage the demands of college is preparing schedules. A daily schedule helps you to prioritize your obligations and tasks. They also put less stress on you depending on your memory. A schedule will allow for you to add time when a important project is coming up and you need to prepare in stages. This adding of time will allow for you to attend to your personal obligations while making time for your school obligations. It also gives you the sense of accomplishment when you are able to start crossing off your schedule. This accomplishment in turn gives motivation for you to stay on top of your duties and stay consistent. Another important strategy for college success is utilizing all the available resources colleges have available. Many institutions provide access to libraries with faculty ready and willing to help whenever you need to ask. This can really ease the stress level when you have major projects or papers due. They are familiar with the college and faculty and are able to give you approprate advice. Also on the faculty of many colleges are counselors. These individuals are trained to guide you in course selection and degree plans. They are familiar with the schools curriculum and requirements and can help you make informed decisions. Higher learning institutions may also provide programs that include child care to job placement. Taking advantage of these programs is vital to maintaing your success while in college. Most importantly, one of the best strategies for college success is setting goals for yourself. Goals can be set in a variety of areas which makes goals so helpful. The most important part to remember about setting goals is to write them down so you can visualize your goals daily. You can set short term goals and include steps to how you are going to achieve them. You can, at the same time, set long term goals. Your short term goals will be steps to getting to your long term. You can also stay motivated about your goals by placing rewards when you do achieve them. I belive these strategies are important ingredients to college success and can be implemented by maintaining consistent levels of personal responsibility. ââ¬Å"This clearly shows that a person cannot only be defined in a consistent way by a series of added characteristics, whether they be rights, capabilities, or freedomsâ⬠(Ballet, Dubois, Mahie, 2007). Conclusion Personal responsibility is a trait that everyone obtains, and everyone practices personal responsibility in different ways. The key to a productive lifestyle is practicing your level of personal responsibility to the highest degree. And with that practice to always engage in moral and ethical behaviors as well. I believe in consitently staying responsible in all your tasks and this in turn can open the doorway to accomplishing all of your dreams. We hold the power and the control of our destiny and it all starts with the term personal responsibility. Utilzing personal responsibilty in all aspects of your life is the key to your happiness and your future. Take it from the wise words of Abraham Lincoln, ââ¬Å"You cannot escape the responsibility of tomorrow by evading it today. ââ¬

Child Observation Case Study
Child Observation Case Study Care has been taken to ensure the provisioning of adequate information to the mother of the child to be placed under observation. I have informed the mother of my reasons for conducting the exercise. I have reassured her on the protection of confidentiality of all my observations and have informed her that I will use a pseudonym for referring to her daughter in all my written work. I have accordingly asked her to chose a pseudonym for her daughter and have accepted her suggestion for calling the child Kirsty. Kirstys mother, Jane, has been informed that the child will not be influenced or pressurised in any way. She will be free to answer or not to answer questions and even to withdraw from the exercise at any time she so desires. I have obtained her consent to the conducting of the observation exercise in writing. The signed consent statement is available in Appendix 1. Whilst Kirstys father was not at home at the time of the study, Jane informed me that he was aware of the exercise and had agreed to the same. 1.3. Observation Process The exercise was conducted at the garden of Kirstys house. Kirsty lives with her parents in a small cottage near the beach. The house has a small fenced garden. It was quiet and sunny when the observation was conducted in the presence of Jane, and her neighbour, Priya, a young woman in her mid-twenties. Whilst it is recommended that the observation was conducted in the presence of the childs mother, care should be taken to ensure that she does not actively participate in the observation process. I carried the Sheridan Scale for 5 year olds for the exercise and noted my observations in the appropriate boxes during the observation process. The observation began at 11 am and continued for a couple of hours, wherein I observed Kirstys behaviour in the course of some small games that she played, first with her dolls and then with her set of building blocks. 1.4 Views of Family Jane informed me about Kirstys mild asthma, which had first surfaced when she was three and continued to trouble her even today. She was under medical treatment and her GP had advised her that most children outgrew childhood asthma by the time they were 15 or 16 years old. Jane informed me happily about the childs excessive attachment to her father, who had a travelling job and was out of the home for more than two weeks each month. Whilst both parents loved their daughter, the father absolutely doted on her and showered her with gifts when he was home. The child had of late begun to act wilfully and was apt to become very upset and show signs of aggressive behaviour if her wishes were not met immediately. Her school teacher had also spoken to Jane about Kirstys wilful behaviour athatupset once in a while. 1.5. Summarisation of use of Sheridan Scale and Assessment Framework Triangle Asthma, even if it is mild, is known to adversely affect the development of children. Janes information on the whole reinforced my findings from the application of the Sheridan scale for 5 year olds. I had carefully applied the Sheridan test for various parameters, including posture and large movements, vision and fine movements, hearing and speech, and, to some extent, social behaviour and play. Whilst the child responded positively to the various facets of the test, and was particularly proficient in dancing with me to tapping of feet, skipping, sketching and painting, she appeared to have trouble in skipping and in participating in more strenuous forms of physical activity. Her mother also became apprehensive if the child engaged in dancing and running. I also found her to be more wilful and apt to become upset if she did not find what she was looking for, or if her smaller wishes, like asking for a glass of water were not immediately fulfilled. She appeared to miss her father, who had to constantly go on business trips. The Common Assessment Framework triangle helped me in understanding the developmental needs of the child from three perspectives a) the developmental needs of the child b) family and environment factors and c) parenting capacity. Use of the CAF triangle helped me in realising that whilst the parents were taking good care of her various physical, health and educational needs, their overprotective nature was resulting in slowing down of her self care skills as well as her emotional and behavioural development. 2. Psychological Theories and Life Span Development Cognitive development is a process whereby a childs conception of the world alters with respect to age and experience. Cognitive psychology, primarily known as the developmental stage theory, seeks to explain the quantitative and qualitative intellectual abilities that occur during a childs developmental years. The work of Piaget is important in understanding human development. Piaget suggests that the idea of cognitive development is intrinsic to the human organism and language is contingent on cognitive development. Piaget proposed that reality is essentially a dynamic structure of continuous change, one that involves transformations and states. Whilst transformations refer to the various changes that a person/thing undergoes, states refer to periods in between transformations. A childs cognitive development is primarily dependent on his/her ability to adapt to various situations. Therefore, if human intelligence is to be adaptive, it must be able to represent both the transformational and static aspects of reality. He suggested that whilst operative intelligence directs dynamic or transformational aspects of reality, figurative intelligence represents static periods in between. In understanding cognitive development, Piaget essentially focuses on accommodation and assimilation. Whilst the former focuses on absorbing ones environment by altering pre existing schemas in order to fit the new information, the latter concentrates on assimilating new information by fitting it into pre existing cognitive schemas. Whilst placing Kirstys development within the context of Piagets stages of development in it recognises that children adopt particular types of behaviour and actions during each stage I feel that she was adequately well developed, both operatively and figuratively. Moreover, she was able to assimilate and accommodate to the environment with equal ease. Her enthusiasm to play Introduction Community care essentially aims to provide individuals in need with social, medical and health support in their own homes, as far as possible, rather than in residential establishments or in long-stay institutions. The enactment of the NHS and Community Care Act in 1990 marked a watershed in the evolution of community care practice in the UK (Means, et al, 2002, p 71). Implemented after years of discussion on the social and financial viability of maintaining people in institutions and homes, the NHS and Community Care Act, initiated by Margaret Thatcher, showcased her desire to radically change the practice and delivery of social and health care in the UK (Means, et al, 2002, p 71). The years following the passing of the Act have witnessed significant developments in the practice and delivery of social work in the country. This short essay attempts to investigate the basic reasons for the enactment of the NHS and the Community Care Act, its basic ideology and thrust, and its impact on the social work sector of the country. The essay also studies the developments in social care that have occurred in the years following the act, with particular focus on direct payments for people with learning disabilities, social care provisions for carers and the contemporary emphasis on personalisation. NHS and Community Care Act 1990 Whilst the initiation of the policy of community care in the UK is by and large attributed to Margaret Thatchers conservative government, the concept of community care, even at that time, was not exactly new (Borzaga Defourny, 2001, p 43). The need for community care existed from the beginning of the 1950s. It aimed to provide a better and more cost effective way to help individuals with mental health concerns and physical disabilities by removing them from impersonal, old, and often harsh institutional environments, and taking care of them in their home environments (Borzaga Defourny, 2001, p 43). Although various governments, since the 1950s, supported the need to introduce community care and tried to bring in appropriate changes, lack of concrete action on the issue resulted in constant increase of the number of people in residential establishments and large institutions during the 1960s, 70s and 80s (Borzaga Defourny, 2001, p 43). With numerous negative stories coming out in the media on the difficult conditions in such establishments, Sir Roy Griffiths was invited by Margaret Thatcher to investigate the issue of community care for the residents of such establishments and make appropriate recommendations (Harris, 2002, p 11). The Griffiths, (1988), Report named Community Care: Agenda for Action, followed by the publication of a White Paper Caring for People: Community Care in the Next Decade and Beyond in 1989 led to the enactment of the NHS and Community Care Act 1990 (Cass, 2007, p 241). Apart from being a strong attempt to improve the lives of people in long term institutions and residential establishments, the law was also an outcome of the conservative governments desire to bring market reforms into the public sector and stimulate the private sector to enter the social services, as well as its conviction that competitive markets would be better able to provide more economic services than a bureaucratised public sector (Harris, 2009, p 3). With social services being among the highest revenue spending departments at the local authority level and domiciliary and residential services for older people consuming the bulk of social service funds, community care for older people presented an obvious area for introduction and implementation of market principles (Harris, 2009, p 3). The act split the role of local and health authorities by altering their internal structures, so that local authority departments were required to ascertain the needs of individuals and thereafter purchase required services from providers (Lewis, et al, 1994, p 28). Health organisations, in order to become providers of such services, became NHS trusts that competed with each other. The act also required local social service and health authorities to jointly agree to community care plans for the local implementation of individual care plans for long term and vulnerable psychiatric patients (Lewis, et al, 1994, p 28). The act has however come in for varying degrees of criticism from service users, observers and experts, with some observers claiming the altered care conditions to be unresponsive, inefficient and offering little choice or equity (Malin, et al, 2002, p 17). Other experts, who were not so pessimistic, stated that whilst the system was based upon an excellent idea, it was little better in practice than the previous systems of bureaucratic resource allocation and received little commitment from social services; the lead community care agency (Malin, et al, 2002, p 17). The commitment of local authorities was diluted by the service legacies of the past and vested professional interest, even as social services and health services workers were unable to work well together (Malin, et al, 2002, p 17). Little collaboration took place between social and health services and the impact of the reforms was undermined by chronic government underfunding. The voluntary sector became the main benefici ary of this thrust for the development of a mixed economy of care (Malin, et al, 2002, p 17). Developments after the Enactment of the NHS and Community Care Act The assumption of government by the labour party in 1997 resulted in the progressive adoption of numerous forward looking policies in various areas of social care. The publication of a white paper in 1998 reinforced the governments commitment to promotion of community based care and peoples independence (Means, et al, 2002, p 79). The paper focused on assisting people to achieve and maintain independence through prevention and rehabilitation strategies, with specific grants being introduced to facilitate their implementation. The Health Act of 1999 removed obstacles to the joint working of health and social services departments through provisions for pooling of budgets and merging of services (Means, et al, 2002, p 79). The formulation of the NHS plan aimed to improve partnership between health and social care, the development of intermediate care and the construction of capacity for care through cash for change grants for development of capacity across social and health care systems (Means, et al, 2002, p 79). Direct Payments for Individuals with Learning Disabilities The Community Care (Direct Payments) Act 1996, which came into operation in April 1997, marked a radical change in the provision of community care for people with disabilities, including those with learning difficulties (Tucker, et al, 2008, p 210). It was illegal, prior to the implementation of the act, for local authorities to support people with disabilities by making cash payments in lieu of providing community care services. Policymakers however realised that many local authorities were successfully supporting independent living schemes, centres for independent living and personal assistance schemes (Tucker, et al, 2008, p 210). Such schemes handled community care payments for disabled people and provided them with help to organise assistance or support. The Community Care (Direct Payments) Act built on this situation, allowing direct payments to be made to replace care services, which otherwise would be given by social service departments (Tucker, et al, 2008, p 210). Direct payments provide flexibility in the way services are provided to eligible people. The giving of money, in lieu of social care services, helps people to achieve greater control and choice over their lives and enables them to decide on the time and mode of delivery of services (Tucker, et al, 2008, p 210). Direct payments can not only be used for services to satisfy the needs of children or their families but also enables carers to purchase the services they need to sustain them in their roles. Research conducted in 1997 in the utilisation of direct payments by people with learning difficulties revealed that whilst utilisation of direct payments by people with learning disabilities was increasing, such utilisation was low among women and individuals from minority or black ethnic groups (Tucker, et al, 2008, p 210). Research also revealed the presence of wide differences in the interpretation of the capacity of persons for consenting to direct payments by local authorities. Whils t some local authorities felt that direct payments could be sanctioned to all persons with learning difficulties who were able, with assistance, to successfully control and use direct payments, other authorities did not heed the fact that such people could indeed be assisted to communicate decisions and consequently assumed their inability to consent to direct payments. Such interpretations, it was felt, could debar many people in need from obtaining the facility for direct payments (Tucker, et al, 2008, p 211). Assistance for Carers Recent years have seen a number of social care initiatives for easing the condition of carers. Carers are people who provide assistance and support, without payment, to family members or friends, who are unable to manage without such assistance, on account of illness, frailty or disability (Government Equalities Office, 2010, p 1). Carers can include adults who care for other adults, parents who care for disabled or ill children, or young people who care for other family members. The governments social care policies for carers include supporting people with caring responsibilities for (a) identifying themselves at early stages, (b) recognising the worth of their contribution, and (c) involving them from the beginning in designing and planning individual care (Government Equalities Office, 2010, p 1). Such policies aim to enable carers to (a) satisfy their educational needs and employment potential, and (b) provide personalised support, both for carers and the people they support, to enjoy family and community life and remain physically and mentally well. Whilst the NHS and community care Act 1990 looked at carers as valued resources because of their ability to provide support, it did not refer to their rights; relying instead on rhetoric to deliver the message of their value to society (Government Equalities Office, 2010, p 2). Succeeding years have however witnessed greater focus on the needs of carers and to progressive introduction of suitable laws and appropriate policies. The passing of the Carers (Recognition and Services) Act 1995 drew attention to the needs of carers. This was followed by the passing of the Carers and Disabled Children Act 2000 and the Carers (Equal Opportunities) Act 2004 (Government Equalities Office, 2010, p 2). These acts entitle carers for (a) assess ment of their needs, (b) services in their own right and support in accessing education training, employment and leisure opportunities. The proposed equality bill introduces four new opportunities for carers. It (a) requires public authorities to give due consideration to socio-economic disadvantages, whilst exercising strategic planning functions, (b) takes account of associative discrimination with regard to disabled people, (c) provides for prevention of indirect discrimination, and (d) calls upon public bodies to ensure that their policies are designed to eliminate harassment and discrimination and further equality of opportunity (Government Equalities Office, 2010, p 2). Personalisation The concept of personalisation in social care, whilst discussed for some years, was formally inducted into social care practice in the UK with the publication of Putting People First in 2007. The concordat outlined the concept of a personalised adult social care system, where individuals will have extensive control and choice over the services received by them. The government committed that social services would progressively be tailored to meet the preferences of citizens, with person centred planning along with self directed support becoming mainstream activities, assisted by personal budgets for maximising control and choice (Aldred, 2008, p 31). Whilst personal budgets and direct payments form an important aspect of personalisation, the idea concerns fitting services to the needs of people, focusing on outcomes, and recognising the worth of the opinions of service users assessing their own needs, planning their service, and producing their outcomes (Aldred, 2008, p 31). Conclusions and the Way Forward This essay investigates the reasons behind the enactment of the NHS and the Community Care Act and studies the developments in social care that have occurred in the years following the act, especially in areas of direct payments for people with learning disabilities, social care for carers and personalisation. It is obvious from the results of the study that social care in the UK has experienced significant change and metamorphosis since the enactment of the 1990 act. Whilst significant progress has been made a consensus s growing that the British social care system is facing a crisis because of drivers like increasing demographic pressures, alterations in family and social structures, rising public expectations, increasing desire for greater choice and control, and eligibility for services (Glasby, et al, 2010, p 11). The need to move people out of local accommodation because of rising rents exemplifies the challenges faced by the social care system. With the financial system becoming more challenging, the social care system will have to find ways of improving efficiencies without diluting the quality of care (Glasby, et al, 2010, p 11). The next round of social reforms, whilst attempting to achieve better delivery efficiencies will have to renew its commitment to satisfying social expectations and basic human rights, reducing costs, preventing future needs, helping people to regain independence, freeing individuals to contribute, and supporting carers to care and contribute to society (Glasby, et al, 2010, p 11).

Curfews: What's the Point? The 14th amendment of the United States Constitution states that any state shall not ââ¬Å"deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws" (Legal). However, many cities and states in the US currently enforce curfew laws that deny young teens under the age of 18 their right to be in public places or to drive after certain hours. These laws are punishing minors for exercising their constitutional rights in the same way that adults do without such punishment; they are mostly causing no harm, and do not deserve to be discriminated against by the government in the way they are. Many believe that teens are responsible for a large percentage of crimes, particularly violent ones, and that having a curfew in effect helps lower crime rates. In one study, the average adult surmised that teens amount for 43% of all violent crimes, when in reality the number is only a mere 13%, and this number is made up by only a half percent of minors (Cobey). If this is the reason for creating curfews, it is clearly a discrimination against all minors, as reproving 99.5% of young citizens due to an inconsequential number of minors committing crime is certainly unjust. How Moods Are Affected By The Sun Thesis: The amount of sun people receive affects their mood. A young woman lies asleep on a cold, overcast winter morning. At 4 A.M., a faint incandescence radiates from a light bulb placed near her bed. The light gradually gains intensity and covers until 6 A.M., when the woman awakes. She had just experienced a simulated dawn of a new day. After being treated with this for several days, the woman's annual winter depression slowly goes away. Does this mean that the less sun you get the worse you feel, or perhaps the more you get the better your mood? It is very possible that you may feel this way as millions of people worldwide have experienced it first-hand. This phenomena is still sort of a mystery as many researchers don't completely understand why this happens. "It may be that certain individuals have inherited vulnerability that causes them to develop depression in the absence of exposure to sufficient environmental light"1. Frederick A. Cook, the arctic explorer, provided a vivid description of the effects of prolonged darkness on the human psyche: "The curtain of blackness which has overfallen the outer world has also descended upon the inner world of our souls," Cook wrote in his journal on May 16, 1898, "Around our tables . . . . men are sitting about sad and dejected lost in dreams of melancholy. For brief moments some try to break the spell by jokes, told perhaps for the 50th time. Others grind out a cheerful philosophy; but all efforts to infuse bright hopes fail."2 Some believe that light affects the body's ability to make serotonin, a neurotransmitter that helps induce feelings of calm and well being. The eye's sensitivity may also play a part in sun/mood relations. A study was done to a group of people in the winter and summer. In the winter the many individuals experienced much more difficulty seeing dim light after sitting in the dark for a while.3 Another study done in Vancouver shows that electrical activity in the retinas when a bright light is shone, is significantly less in winter4. As much as 5% of Americans suffer from Seasonal Affective disorder, also known as SAD5. SAD is an illness in which the sufferers feel depressed, feel lethargic, and they overeat . Emi Group Plc In The Music Publishing And Recording Industry Essay
Music and recording industry present interesting development due to the introduction of new artists and the development of new music genre, to name a few. In addition, the industry also experiences significant challenge due to the advancement in digital technology that drives the industry to find appropriate ways in winning the competition. The challenge occurs since there is a difference circumstances in the competition of media industry where previously the existence of new media does not eliminate the old media. The existence of commercial radio, for example, does not kill the print media like magazines and newspaper. Similarly, the existence of television broadcasting also does not eliminate the existence of radio and newspaper. In many cases, the television broadcaster also owns radio and newspapers companies to complement their media business. However, the situation may be completely different in the digital age where the existence of internet and the development of digital technology like file compression (MP3, mpeg, and file-sharing technologies etc) could completely kill the old model of music distribution such as compact disc. The so-called MP3, often refers to MPEG-1 Audio Layer 3, is an audio encoding format that reduce the file size from tens of megabyte (when using WAV or compact disc format) into less than 5 Megabyte (MB) in MP3 format for one same song. Audio Galaxy and Napster are two companies that employ file-sharing technology that enables their members/customers to exchange their music or video with others members/customers (Karp, 2007). Immediately, the invention of new audio encoding format increases the sales of portable digital music players like iPod. Coupled with the increased international internet bandwidth, the exchange of MP3 files rises significantly. A number of websites that enable users or music lovers to download the desired songs in MP3 format also rises. Despite the attractiveness of MP3 technology for audio, MP4, and MPEG for video, the technologies causes severe violation of copyright as downloading music and video without paying royalties to the owners/singers of the music is considered as piracy in digital world/domains. Concerning the challenges in the music and recording industry, this paper will discuss about Emi Group plc, a giant in music and recording industry. In particular, there are several issues including the identification of strategic choices that EMI performs, EMI and its critical success factors in competing in the industry within the last five years, and the use of appropriate management concepts in evaluating the suitability of EMIââ¬â¢s current strategies to deal with future competition. 2. Aim and Objectives The objectives of this paper are to analyze current and future positions of EMI Group plc in the music publishing and recording industry. Systematically, we can derive the objectives into four points. First is to analyze the strategy of EMI Groups plc that positions the company in the music and recording industry. Second is to use the appropriate research methodology, this paper is to assess EMI Group plc and its critical success factor in the last five years. Third is to use the relationship of research approach, deductive, quantitative to explore key resources and capabilities of EMI in the next five years and assess whether they can create sustainable competitive advantage. And fourth is to use the non-participant observation method, collecting data and analyzing qualitative information from journal, books, magazine and online materials, this paper is to adopt the management concepts to evaluate the appropriateness of EMIââ¬â¢s current strategies for the future. 3. This is because it represents not only the greater benefits in terms of products but also in other Ps of marketing mix (place, promotion, and price). The possession of specific competitive advantages increasingly important since nowadays, customers use emotional side than rational side when decide which products or services they want to use (Manjoo, 2003). The rivalry in recording industry is quite intense since EMI Group does not only compete with similar company like Universal Music Group, Sony BMG, and Warner Music Group but also illegal distribution both in traditional and web-based distributors through several kinds of file-sharing program like Napster. Napster becomes the catalysts of online music service (Rupley, 2003). In order to prevent the distribution of illegal copy of music, Hodges Shaw and Brian B Shaw (2003) says that government has persuaded users regarding importance of not using file sharing for copyrighted materials over the Internet by considering it as illegal actions. 3. 2 Barriers to Entry One of common barriers to enter a new market is brand loyalty or in terms of multinational business, the main barrier could be the nationalism. In music industry, one significant challenge that continues gains popularity is iTunes, a legal web-based music distribution from Apple Company. In music industry, especially regarding the competition between EMI Music and p2p companies and iTunes, the brand loyalty is obvious since the fever for iPod products has driven the use of iTunes to download legal music (Manjoo, 2003). The entry to some markets like educations gets fiercer as Jason E. Lane and Margaret A Healy (2005) revealed in their article File Sharing, Napster, and Institutional Responses: Educative, Developmental, or Responsive Policy that file sharing (including music, video, and file sharing) has been parts of students activities. They usually use the internet to share their favorite music and movies illegally. In addition, Scott (2001) and Dong et. al (2002) reveals that file sharing remains a popular services due to their offering free downloading music and video. 3. 3 Products Substitution Impact of product substitution is possibly the most overlooked factor although its impact is damaging. Therefore, it is imperative that business must not only look at what the companyââ¬â¢s direct competitors are doing, but what other types of products people could buy instead. The products substitution for EMI Group is the introduction of various digital formats like MP3 and MP4 that easily downloadable that enables customers to convert the CD format to MP3 and distribute it by e-mail. This is because EMI Group mostly still relies on the distribution of music in CD format that they believe is still better than others do. EMI Groups plc Strategic Position in Music Publishing and Recording Industry Realizing the fierce competition that occurs in the music and recording industry, EMI Group develops several strategies such as the selection of new talents that will hit the market and develop sustainable distribution strategy to speed up the existence in new market. Among the distributions system, EMI Group appropriately conduct joint venture with foreign companies in order to smooth their distribution. One of them is with EMI Televisa joint venture that helps EMI Group to distribute Celestial and other English language album (EMI Group, 2006). The decision to conduct joint venture is a good strategy to be implemented for EMI Group since it is a model in business that composes of two or more enterprises that join hand-in-hand to increase their competitive advantages. In this scheme, joint venture is somewhat similar to partnership but joint venture is derived from one business transaction. Joint venture is preferred because it can help companies to divide potencies, reduce threats, and raise competitive advantages in the market. Joint ventures can be formed as separate business units or cooperation between businesses (ââ¬Å"Corporate Venture Strategiesâ⬠, 2001). Developing a joint venture properly can obtain many benefits and advantages, such as dividing expenses and risks, enhancing right of entry to monetary resources, admission to innovative knowledge and consumers, and admission to new decision-making performs. Moreover, companies are able to have some bearing on structural development of the business. Conduction of knowledge and skills are also accomplished easily (ââ¬Å"Corporate Venture Strategiesâ⬠, 2001). 5. EMI Strategic Choice EMI Group plc is a well-known company in music and recording industry. The company is currently perceived as the fourth largest recording company in the world behind Universal Music Group, Sony BMG, and Warner Music Group. The company main business is the distribution of compact discs, videos, and other formats under the auspices of their subsidiaries and partners including EMI Records, Capitol, and Virgin (Yahoo Inc, 2008). The label company is behind the success of many famous artists such as Norah Jones, Lenny Kravitz, and The Beastie Boys. Currently, the company also handles more than one million songs. The strategic position of the company has attracted many larger companies such as Warner Music Group (WMG) to takeover EMI Group plc. Although many acquisition attempts, the company finally bought by Terra Firma, a private equity firm, for $4. 9 billion in 2007 (Yahoo Inc, 2008). 6. EMI and Its Critical Success Factor The winning strategy of EMI Group exists since the company is suitably conducting several strategies that benefit the company in the long term. One of popular strategy is the decision to outsource their CD manufacturing in Australia. This decision occurred in 2004 where EMI Music and Warner Music conduct agreement with Summit Technology Australia Pty Ltd to own CD Manufacturing business together (EMI Group, 2006). This strategy provides great benefits for EMI Group since the company significantly obtains costs reduction and helps the company to insulate the business from the effects of changing volumes. When discussing the outsourcing business model, the images refer to advantages that organizations obtain, especially refers to costs reduction. However, the benefits of outsourcing do not merely the cost reduction. Figure 3 shows six main reasons of carrying out outsourcing in an organization like EMI Group according to Outsourcing World Summit. Similarly, to costs reduction, outsourcing also provides benefits of helping the company to focus on core competencies. In theory, outsourcing is only used for delegation of non-core activities concerning the mission statement of the company. Nevertheless, many corporations outsource some of their core functions to gain more value in competitive advantage. Furthermore, many if an organization is able to develop a good relationship with its outsourcing partner, the long-term effect would be a sustainable competitive advantage. Another critical success factor is the decision of EMI Group to take benefits of digital technology. Previously, the company relies on tradition supply chain as shown in the Figure 4 below. In traditional supply chain (figure 4), we witness that recording companies make huge revenue and thus the profits from the two elements (in blue boxes). However, this model soon changes considering technology advancement in music like MP3 that immediately spawned illegal peer-to-peer music download over the Internet. Concerning the issue, coupled with wide coverage of high-speed Internet access, recording labels realize that they should change their supply chain to adopt the advancement in information technology as described in the following section. However due to the benefit that digital distribution provides, the company also offers the digital option for the supply chain (Figure 5). By developing the digital distribution, the company starts receiving significant growth on digital revenues. In 2006, digital revenue contributed about 8. 5% of total Group revenues. In addition, digital revenues also experienced significant growth by 78. 2% in 2006, providing more opportunity to receive more revenue from this technology (EMI Group, 2006). In this web-based supply chain model, we witness that recording labels are massively legalize licensing strategy that significantly fire up a legal digital music subscription (in contrast to Napster that was illegal). 7. Key resources and capabilities of EMI in the last Five Years and Suitability, Feasibility, and Acceptability Concepts There are several key advantages and resources the company possessed within the past five years. First is EMI Music keep finding new talents that bear success in UK and North America, in particular, and in the world, in general including Letoya, 30 Seconds to Mars. This strategy represents the feasibility of strategy taken by EMI Group since competitions between recording industries is mainly regarding the artists that the company manages their music creation. Second is the success of current managed artists including popular artist such as All Saints, Keith Urban, Norah Jones, Robbie Williams, and Depeche Mode. This artist management represents the suitability to manage the popular artists and release the unpopular one. Meanwhile, EMI Music Publishing successfully finds songwriting talent that result in the attractive performance revenues that represents the acceptability (EMI Group, 2006) 8. Conclusion In the basic marketing management study, four factors characterize the successful marketing; they are product, place, promotion, and price. In the recording industry while product represented by the artists, distribution or place factor also provides significant contribution to the company. This is in line with Oââ¬â¢Brien and Springman (2004) suggestion that say companies should balance supply and demand since focusing entirely on the supply side may result in unnecessary capital expenditures, inventory investments or suboptimal solutions. Maju Jaya Supermarket (MJ Supermarket) Essay
Maju Jaya Supermarket (MJ Supermarket) advertises in the newspapers that there is a vacancy for the post of manager. The advertisement stated that those who are interested can come anytime to MJ Supermarket for an interview from 11th April 2014 until 21st April 2014. Ahmad who was very interested with the post came to MJ Supermarket on 20th April 2014 and was informed by the owner that the post was already filled. Ahmad was very angry as he has already tendered his resignation to his former company. On the day that Ahmad came to the MJ Supermarket, he saw Mr Chan, his neighbour, entering the MJ Supermarket and selected some canned food, shampoo, eggs and vegetables. He put all the items into his trolley. However, while he was still looking for other items, Mr Chan received a call from his son asking him to pick him up from the train station. Mr Chan left the items in the trolley and went out from the MJ Supermarket. Advise Ahmad and Mr Chan whether there is any contract between them and the MJ Supermarket. (20 MARKS) ANSWER to Part A (Ahmad Case) Introduction The definition given under the Section 2(h) of the Contracts Act 1950 is that a contract is an agreement enforceable by law (The Commissioner of Law Revision, 2006). Therefore in the Ahmadââ¬â¢s case, one of the parties (Ahamd or MJ Supermarket) has to make an offer that is duly accepted by the other. Issue First issue that we need address in this case is to see whether the advertisement stating the interview deadlines contains an offer. If it does, can Ahmadââ¬â¢s willingness to attend the interview be considered as an acceptance of the offer? In case the advertisement is not considered as an offer, or if it is just an invitation to treat, then there is no contract between them. Second issue raised by the question is whether Ahmadââ¬â¢s presence in the MJ Supermarket to attend the interview on time, after his resignation from his previous job, is an offer. In that case, does MJ Supermarket can reject Ahmadââ¬â¢s offer? Based on the limited information given in the Ahmadââ¬â¢s case, the issues were analysed to see whether there is a contract between both parties? The Law According to Section 2(a) of the Contracts Act 1950, an offer exists ââ¬Å"when one person signifies to another his willingness to do or to abstain from doing anything, with a view to obtaining the assent of that other to the act or abstinence, he is said to make a proposalâ⬠(Rahman , 2011). As given in the Carlill v. Carbolic Smoke Ball Co Ltd (1893) 1 QB 256 case, a proposal or an offer can also be made to the general public to be accepted by any person who knows about it and willing to perform the requirements of the proposer. On the other hand, an invitation to treat can be defined as giving information or requests to others to make offers. Application of the Law to the Facts of the Problem The advertisement by the MJ Supermarket clearly states that those who are interested can come anytime to MJ Supermarket for an interview from 11th April 2014 until 21st April 2014. This raise the question whether the advertisement is intended to bound in contract with the participants who come for the interview. In case of COELHO v. THE PUBLIC SERVICES COMMISSION[1964] M.L.J.12, the applicant, a Health Inspector under the Town Board, Tanjong Malim, applied for the post of Assistant Passport Officer in the Federation of Malaya Government Oversea Missions advertised in the Malay Mail dated 19 February 1957. Consequently, the applicant was informed that he was accepted and, after undergoing training, he was posted to the Immigration Office, Kuala Lumpur, where he remained until December 1958 when he was transferred to the Immigration Office at Johor Bahru (Rahman , 2011). The High Court ruled that the newspaper advertisement was an invitation for qualified persons to apply and the applications were treated as offers. Same can be expressed to the case of Ahmad that the newspaper advertisement by the MJ Supermarket is an invitation to those who are interested to participate in the interview. In the case of Gibson v Manchester CC [1979] 1 All ER 972, HL local council write to tenants inviting them to apply to purchase their homes. One such tenant P did apply, and a price was agreed. Following a change of party control, the new council DD refused to go ahead with the sale. The House of Lords said there was no binding contract: P had made an offer which DD had not yet accepted. Phrases in the correspondence such as ââ¬Å"may be prepared to sellâ⬠and ââ¬Å"please complete the enclosed application formâ⬠were indicative of an invitation to treat (Thomsonà Reuters, 2004). Similarly to this case, the advertisement by the MJ supermarket stated th at those who are interested ââ¬Å"can comeâ⬠any time to the interview is crucial to consider that the advertisement was a step in the negotiation for a contract. Conclusion Considering the court ruling on both Coelhoââ¬â¢s case and Gibsonââ¬â¢s case, the advertisement made in the newspaper was an ââ¬Å"invitation to treatâ⬠. However, the presence of Ahmad to participate in the interview is considered as an offer. The MJ Supermarket rejected this offer. Therefore the advice to Ahmad is that there is no contract between himself and the MJ Supermarket. Application of the Law to the Facts of the Problem Mr Chan took goods by himself suggests that there is a display of goods in the MJ Supermarket and allows customers to voluntarily pick goods they like and purchase from the counter. ââ¬Å"In the case of Fisher v Bell [1960] 3 All ER 731, DC it was a statutory offence under the Restriction of Offensive Weapons Act 1959 to offer for sale any of various items, including flick-knives. A Bristol shopkeeper R displayed such a knife in his window, with a ticket reading ââ¬Å"Ejector knife ââ¬â 4s.â⬠[4 shillings = 20p], and was prosecuted for an offence under the Act. The Divisional Court took a literal interpretation of the statute and said he had committed no offence: the display was an invitation to treat, not an offer to sellâ⬠(Rahman , 2011). In relation to the Mr Chanââ¬â¢s scenario, this case can be used to justify an argument of changing mind at any point of purchase before a contract is made. Therefore Mr Chanââ¬â¢s decision to leave the goods without buying is acceptable based on Fisherââ¬â¢s case. ââ¬Å"In the case of Pharmaceutical Society v Boots [1953] 1 All ER 482, CA certain products that were to be sold only under the supervision of a registered pharmacist were displayed on shelves in a self-service shop. The Pharmaceutical Society of Great Britain (who are responsible for enforcing this legislation) brought a prosecution against the shop for allowing customers to buy these products by helping themselves, but the Court of Appeal (upholding Lord Goddard CJ) said they had no case. The customer having selected the goods made an offer to purchase when he took them to the cash desk, and there was a registered pharmacist supervising that point at which the sale took placeâ⬠(Rahman , 2011). Mr Chan does not take the goodsà to the sales counter. In the case it is also mentioned that he was still looking for goods to purchase. However, he revoked from the process of making an offer to the sales staff when he got a phone call. As mentioned in the Boots case, the action by Mr Chan indicates that he did not properly complete an offer to purchase. In other words, he was involved in an invitation to treat from the MJ Supermarket. Conclusion To complete a contract between Mr Chan and MJ Supermarket, there is should clear communication of an offer and acceptance between both parties. Based on the discussed cases above, the display of goods are considered as an invitation to treat. Mr Chan does not complete an offer to purchase the goods as he quit his process of purchasing in the middle before taking goods to the sales counter. Futhermore, the MJ Supermarket does not have knowledge of a possible offer from Mr Chan.
